"The Company" shall mean Orthomed Systems Worldwide Ltd.

Settlements

Payment of all accounts will be due 30 days from the date of invoice and shall be strictly nett. The Company reserve the right to levy a surcharge for late payment. Products remain the property of the Company until full settlement has been made. Any account overdue by more than 45 days will be placed on stop and the customer notified. Re-instatement will be made only when the account is brought back to current trading terms.

Discounts

Quantity discounts may be available on specific items from time to time. price upon request.

Carriage

The Company will select the most economic method of delivery of all goods and or services. Please allow up to 5 working days for delivery of reports and stock products. Carriage charges will be added to the cost of all products unless previous arrangements have been made.

Trades Descriptions Act

Whilst every care is taken to describe our products accurately, customers should satisfy themselves that such products meet their specific requirements. The Company reserves the right to alter, improve or amend specification on all items without prior notice.

Health & Safety at Work

Our recommendations and suggestions for both products and orthoses are based upon the assumption that tests and information given are reliable. If any goods supplied by us prove, on examination, to be defective or faulty in material or workmanship, we undertake at our option to replace the item or refund to the purchaser the price of the goods. We shall not, under any circumstances whatsoever, be liable for damages whether consequential or otherwise however caused. However, the purchaser's statutory rights remain unaffected by these conditions. The purchaser shall determine the suitability of the products for his or her intended use and under no circumstances will our liability exceed the limitations set out in the preceding paragraphs.

Orthotic Devices

The Terms and Conditions for the supply of functional foot orthoses are available upon request.

Device Warranty Scheme

Full details of the Warranty scheme offer and supply of application forms are available from Orthomed's office. The warranty covers bespoke functional foot orthoses for 2 years from the date of despatch from the Company - this is inclusive of the 6-month guaranteed period.
The agreement covers devices that have been outgrown prior to the patient's 18th birthday.
For replacement of devices a surcharge must be paid at the time that the replacement is made. Charges are stated in the warranty offer.
One total refurbishment and one minor refurbishment of orthotic devices are permitted under the scheme. Additional refurbishments will be charged at 25% discount to list prices.
Two prescription adjustments are permitted in addition to the standard adjustment/repair guarantee of the 6-month guarantee.

Patient Data

All scan data and device prescription information is stored at the laboratory six months from the date it is received. On occasion, data disks may become corrupted during downloading to the company's computers. Since this is sometimes unavoidable, we may request you provide the laboratory with a re-burned information disk. The company cannot be held responsible for disk re-burn costs or possible reproduction of data. In order to incorporate all of the biomechanical aspects of the foot, while allowing for changes in the structure of the foot, Orthomed strongly recommends re-scanning the patient after more than six months from the previous scan and data capture.

Six-Month Guarantee

Subject to the conditions laid out below the Company guarantees the shell of bespoke functional devices for life and further guarantees the specification and accuracy of its orthotic devices and that they will be free from defects in materials and workmanship for a period of six months from the date of despatch from the company. The following conditions apply:
• The Company shall not be under any liability in respect of any defect in the orthotic devices arising from any error or inadequacy in the specification or prescription initially supplied by the practitioner.
• The Company shall not be under any liability in respect of any defect in the device arising from fair wear and tear, wilful damage, negligence, failure to follow the Company's instructions (whether verbal or in writing), misuse or alteration, or repair of the devices by the practitioner without the prior approval of the Company.
• Any suggestion, recommendation or advice made by a representative of the Company to a prescribing practitioner in respect of the devices does not convey any expressed or implied acceptance of responsibility of therapeutic results, fit to footwear or tolerance of the devices, all of which are exclusively in the domain and under the control of the prescribing practitioner.
• All damaged or defective devices must the returned to the Company before replacement can be made. No refund of cash will be made.
• Orthotic devices may be returned to the Company for one readjustment only. This must be submitted within a maximum of 12 weeks after the date of despatch from the Company and the above conditions apply - lest a charge will be incurred.

A charge plus postage and handling will be made for refashioned or repaired devices, for additions and replacement of component parts and for alterations or adjustments to prescription contours which are performed during the guaranteed period at the direction of the prescribing practitioner. Charges available upon request from the company.

Stock Product Sales

A 15% restocking charge will be made in respect of current stock items returned if incorrectly ordered by the customer. We will not accept back goods ordered or manufactured to the specific requests of the customer. We will not accept return of goods unless prior authority has been obtained from the Company and a returns number issued by the company will be required.
